About TOBAN Exemptions (TOBEX)

Certain activities, such as Fireworks, may be exempt from Total Fire Bans (TOBAN) - see NSW Government Gazette, 9 February 2018, No.16 for full schedules or the Schedule of Standard Exemptions to Total Fire Bans in the NSW Rural Fire Service website link here.

Under Schedule 4 of the NSW Government Gazette;

1. Fireworks lit, maintained or used as part of an organised public display, provided that:

a. the person supervising the event (the responsible person) holds a current pyrotechnician's licence issued by SafeWork NSW and has notified SafeWork NSW of the display in such manner specified, and approved by SafeWork NSW, and

b. the responsible person complies with any requirements specified by SafeWork NSW, and

c. the landholder has given written approval for the display to be held on the land, and

d. all fire is extinguished at the conclusion of the display and prior to the responsible person leaving the site, and

e. the display is conducted in a manner, which minimises the likelihood that fire will impact on the land surrounding the display causing a fire, and

f. precautions are taken to prevent the escape of fire from the surrounding area, and

g. the responsible person:

i. if the land where the display is to be held is within a rural fire district—has notified the NSW Rural Fire Service Fire Control Centre for that district of the proposed display, or

ii. if the land where the display is to be held is within a fire district—has notified the officer in charge of the nearest Fire and Rescue NSW fire station of the proposed display*, and

h. the responsible person complies with any direction or additional condition which may be imposed by the NSW Rural Fire Service or Fire and Rescue NSW, which may include a direction that fireworks not be lit.

2. Notification under subclause (1) (g) must be given during business hours and not less than 48 hours prior to the commencement of the display*.

Fire and Rescue NSW (FRNSW) respects the privacy of members of the public and other government agency employees who use our services and of our employees and volunteers. As a NSW government agency, FRNSW must comply with the NSW Privacy and Personal Information Protection Act 1998 and the Health Records and Information Privacy Act 2002 which regulate the collection, storage, quality, use and disclosure of personal information.

The purposes for which the information is being collected: Your responses are collected to allow FRNSW to capture information that provides the necessary details regarding notification of Fireworks.

Email addresses: FRNSW will only record your email address to be used or disclosed for the purpose for which you have provided it. It will not be added to a mailing list or used or disclosed for any other purpose without your consent.   

The intended recipients of the information: Your details are stored securely on a third-party communications platform (Snapforms) and are only accessible by FRNSW staff. Only FRNSW staff who are responsible for managing this information can access this service. The Firing End Date and Time provided is earlier than the Firing Start Date and Time - please revise.

You have not provided the mandatory 48 hour notification to FRNSW. 

Fire and Rescue NSW’s role is limited to assessing whether conditions are safe for the fireworks display to proceed. Please ensure that all relevant safety and risk assessment documentation is provided to support this assessment.

To comply with the NSW Schedule of Standard Exemptions to Total Fire Bans, {{company}} is responsible for notifying SafeWork NSW of the fireworks display at least seven (7) working days prior to the event. {{company}} must also ensure that all required licence and safety verification activities have been completed and approved by SafeWork NSW.

To comply with NSW Schedule of Standard Exemptions to Total Fire Bans, {{company}} is responsible for ensuring that written permission has been obtained from the Landholder for use of fireworks on their Land, as specified here (external link SafeWork).

It is the responsibility of {{company}} to ensure all checks are completed as required by SafeWork NSW.

Fireworks Risk Managment

Please provide copy of specific written risk assessment that ensures the safety of all persons, property, etc (as per Condition 3.2: condition of pyrotechnics licence). Event firing maps, risk assessment documents detailing measures to prevent the escape of fire will be used to determine fire safety.
